KEITH HAMILTON AC tEih. ; ae SENIOR PROCUREMENT EXECUTIVE SUBJECT: ACTION: Sign the Fee Determining Official Designation Letter ISSUE: Sign the attached letter designating National Nuclear Security Administration (NNSA) Fee Determining Official (FDO) responsibilities to David Huizenga, Associate Principal Deputy Administrator. BACKGROUND: NNSA Policy Letter-4C (NAP-4C), Corporate Performance Evaluation and Process for Management and Operating Contractors, does not identify the position responsible for serving as the FDO. Historically, the Administrator has delegated FDO responsibilities to the Principal Deputy Administrator or Associate Principal Deputy Administrator. This authority is not specifically mentioned in the Department of Energy Acquisition Regulation and is contained within the contracting authority for NNSA, which is vested in the Administrator. SENSITIVITIES: None. POLICY IMPACT: None. URGENCY: The next FDO meeting is scheduled for July 16, 2019. RECOMMENDATION: That you sign the FDO Designation Letter. Under the authority vested in me as Under Secretary of Nuclear Security, David Huizenga is hereby designated the Management and Operating Contracts Fee Determining Officiai, as that title and its responsibilities are described in NNSA Policy Letter-4C (NAP-4C). RECISSION. This rescinds all previous designations. LIMITATION. 3.1. This designation covers all parts of NNSA, 3.2. In exercising the designated authority in this order, the designee shall be governed by the rules and regulations of DOE/NNSA and the policies and procedures prescribed by the Secretary of Energy or Deputy Secretary of Energy or Under Secretary of Nuclear Security/Administrator. 3.3. Nothing in this order precludes the Under Secretary of Nuclear Security from exercising any of the authority delegated by this order. 3.4. | Nothing in this order shall be construed to supersede or otherwise interfere with the authorities provided to the NNSA Administrator by law or delegation. 3.5. Any amendments to this order shall be made in consultation with NNSA General Counsel. AUTHORITY TO REDESIGNATE. This designation may not be redesignated or delegated. A copy of this designation shall be provided to Business Services through the Policy Division, which manages the designation of authority system for NNSA. DURATION AND EFFECTIVE DATE. 5.1. All actions by the designee pursuant to any authority provided prior to this order or pursuant to any authority granted by this order taken prior to and in effect on the date of this order are ratified and remain in force as if taken under this order, unless or until rescinded, amended or superseded. 5.2.
