I approve your request for Safety Design Basis and Safety Basis Approval Authority for the Pantex Plant and the Y- 12 National Security Complex. This memorandum documents my approval of the requested delegation. Your qualifications and experience were evaluated according to the National Nuclear Security Administration (NNSA) procedure for delegating nuclear safety authority (Reference 2). A detailed evaluation of your qualification and experience for the requested nuclear safety authorities was performed by my staff in the Office of Safety. The staffs evaluation, attached, determined that you meet all of the requirements; therefore, no compensatory measures are required to grant the requested delegation. The NNSA Production Office’s (NPO’s) capabilities, capacities, and framework to support your request for exercising delegated nuclear safety authorities were recently evaluated during the Headquarters Biennial Review (BR) of the office’s nuclear safety performance conducted from April through June 2016. The BR team reviewed NPO’s exercise of delegated nuclear safety authority in the area of Safety Basis and other related functional areas. The BR team determined that persons within NPO with delegated safety authority are adequately supported by its staff. However, the Technical Qualification Program was graded as “Does Not Meet Expectations” because the lack of an effective program could lead to a degradation in NPO’s ability to support delegated safety authority. The performance deficiency in NPO’s program was included in the BR team’s final report as a management concern. On January 26, 2017, your office provided for information the strategy and corrective action plan (Reference 3) for addressing the management concern identified in the 2016 review. The Office of Chief of Defense Nuclear Safety reviewed the plan and determined that the actions would address the management concern. Therefore, in accordance with the authorities granted to me as the NNSA Cognizant Secretarial Officer for Safety, I delegate the following safety design basis and safety basis approval authorities to you: (1) Safety Design Basis Approval Authority for new Hazard Category 2 and 3 nuclear facilities or major modifications (Safety Design Strategies, Conceptual Safety Design Reports, Preliminary Safety Design Reports, Preliminary Documented Safety Analyses, and their associated approval bases documents).

(2) Safety Basis Approval Authority for new or existing Hazard Category 2 and 3 nuclear facilities (Documented Safety Analyses, Technical Safety Requirements, Unreviewed Safety Question procedures, Justifications for Continued Operation, Evaluations of the Safety of the Situation, and Safety Evaluation Reports). Previously delegated authorities for Startup Authority for new Hazard Category 3 nuclear facilities and high-hazard non-nuclear facilities, and Restart Authority for Hazard Category 2 and 3 nuclear facilities (including nuclear explosive operations) and high- hazard non-nuclear facilities, remain in effect. As specified in DOE-STD-1104-2014, Review and Approval of Nuclear Facility Safety Basis and Safety Design Basis Documents, the delegated authorities extended above exclude circumstances where no viable control strategy exists in an existing facility to prevent or mitigate the offsite dose consequence of one or more of the accident scenarios from exceeding the Evaluation Guideline. These delegations remain valid while you serve in your current position and maintain the required qualifications. These delegations may not be further re-delegated. Attachment cc: J.
