NATIONAL NUCLEAR SECURITY ADMINISTRATION DELEGATION ORDER NO. NA-005-03 TO THE PRINCIPAL ASSISTANT DEPUTY ADMINISTRATOR FOR DEFENSE PROGRAMS DELEGATION. Under the authority vested in me under Section 3212 of the National Nuclear Security Administration (NNSA) Act (50 United States Code 2402), I delegate to the Principal Assistant Deputy Administrator for Defense Programs, authority under Title 10 Code of Federal Regulations 712, Human Reliability Program (10 CFR 712) to: 1.1 Provide overall management and direction of the Office of Secure Transportation’s (OST) implementation of the Human Reliability Program (HRP). 1.2. Approve exemptions for the OST under section 712.4, Exemptions, of 10 CFR 712, 1.3 Approve or deny OST nominations into the HRP that are not covered under 10 CFR 712.10 (a), pursuant to section 712.10 (b) of 10 CFR 712. 1.4 In accordance with section 712.24, render final decisions when OST applicants and incumbents have requested an appeal after the Administrative Judge’s decision has been rendered. 1.5 Approve or deny the removal of positions from HRP that meet the requirements of 10 CFR 712.10(a) based on the risk analysis procedure in 10 CFR 712.10(c). This authority may be further delegated to the OST Assistant Deputy Administrator, this authority may not be re-delegated. RESCISSION. None. LIMITATION. 3.1 In exercising the authority delegated in this Order, the delegate shall be governed by the rules and regulations of the Department of Energy, NNSA, and the policies and procedures prescribed by the Secretary and the Administrator. 3.2. Nothing in this Order precludes the Administrator from exercising any of the authority delegated by this Order. 3.3. Nothing in this Order shall be construed to supersede or otherwise interfere with the authorities provided to the Administrator by law or delegation. 3.4 Any amendments to this Order shall be made in consultation with the NNSA General Counsel, 3.5 All authority for providing advice for nuclear explosive duty safety requirements remain with the Office of Nuclear Weapon Surety and Quality. 3.6 3.7 All authority for providing advice for general safety requirements remain with the Office of the Chief of Defense Nuclear Safety. All authority provided under Delegation Order No. NA-005.02 remains with the Chief, Defense Nuclear Security, with the exception of those provided under this delegation. AUTHORITY TO REDELEGATE. Other than the authority listed in 1.5, the authorities listed in this delegation cannot be redelegated. DURATION AND EFFECTIVE DATE. 5.1 5.2 5.2 All actions pursuant to any authority delegated prior to this Order, or any authority delegated by this Order taken prior to and in effect on the date of this Order, are ratified and remain in force as if taken under this Order, unless or until rescinded, amended, or superseded.
